1. Acceptance of terms
By creating an account or using FreshiXport (the "Platform"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
2. Free to use
FreshiXport is completely free to use. We do not charge registration fees, listing fees, commissions on deals, escrow fees, subscription fees, or any other charge for using the Platform. You are responsible only for any costs arising from your own business transactions or third-party services such as shipping, customs or payment processing that you arrange outside FreshiXport.
3. Your account
You must be at least 18 years old and legally able to enter contracts. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate and current information and to update it as needed.
4. Acceptable use
You agree not to: post false, misleading or fraudulent content; infringe intellectual property rights; list illegal, counterfeit or sanctioned goods; harass or defraud other users; send spam; scrape or reverse-engineer the Platform; or use it for any unlawful purpose. We may remove content and suspend or terminate accounts that violate these rules.
5. Listings, requests & transactions
FreshiXport is a marketplace that connects buyers and sellers. We do not participate in transactions between users, do not act as a broker, agent or escrow service, and do not handle any payments. Any agreement, payment, shipping or dispute is solely between you and the other party. You trade at your own risk and are responsible for verifying the identity and reliability of your counterparties.
6. Verification
Verification badges reflect documents submitted by users and reviewed by us. A verification badge is not a guarantee of a user's trustworthiness, financial standing, or the quality of goods, and you should still perform your own due diligence.
7. Intellectual property
FreshiXport and its branding, design and software are our property. You retain ownership of the content you post and grant us a worldwide, royalty-free licence to host, display and process it to operate the Platform. You must not misuse our trademarks or content.
8. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, error-free or secure, or that listings, requests or users are accurate or reliable. Our sole role is to connect buyers and sellers. We are not a party to any transaction between users and bear no responsibility for any scam, fraud, misrepresentation, non-delivery, non-payment, defective goods, or any other loss or damage of any kind arising from your dealings with other users. You conduct all due diligence and trade entirely at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, FreshiXport and its operators shall not be liable for any indirect, incidental, consequential or special damages arising from your use of, or inability to use, the Platform, including any losses arising from transactions with other users.
10. Termination
You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion, with or without notice.
11. Governing law
These Terms are governed by the laws of [Country], without regard to conflict-of-laws principles. Disputes will be resolved in the courts of [Country], unless you are a consumer with mandatory rights in your country of residence.
12. Changes to these terms
We may revise these Terms from time to time. Material changes will be posted on the Platform, and continued use after the effective date constitutes acceptance of the revised Terms.
